BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That Ordinance No. 6958, as amended, known as the Zoning Ordinance, be and the same is hereby amended so as to rezone: A tract of land located at 1426 Williams Street, being Lots 61 and 62, J.C. Stanton's Subdivision, as shown in DB H-2, PG 156, and recorded in DB 4801, PG 492, ROHC. Tax Map No. 145L-B-023. from M-1 Manufacturing Zone to C-3 Central Business Zone. SECTION 2. BE IT FURTHER ORDAINED, That this rezoning shall be subject to the following conditions: 1. Preservation of existing structures as shown on the attached, proposed site plan, except as determined by the Building Official to be unsafe for continued occupancy; 2. No gasoline service stations or adult-oriented establishments shall be permitted on the property; 3. No parking permitted that is unrelated to the use of the building; however, spaces used for the building may be leased; 4. Limitation of the height of the building or structure to 2 to 6 stories; 5. A zero setback orientation to Williams Street is preferred; however, a maximum 15 foot setback can be permitted if a wall, fence, or hedge is provided at the right-of-way and activity is provided between the building and the right-of-way such as a park, plaza, outdoor dining, or sculpture garden; 6. Provide at least one pedestrian entrance from Williams Street; 7. No additional curb cuts on Williams Street; 8. Placement of all dumpsters to the rear of the property is preferred; in all cases, dumpsters shall be screened from any public right-of-way; 9. There shall be a percentage of openings on the ground floor Williams Street facade of no less than twenty (20%) percent; 10. Upper story windows shall have a vertical or square orientation; 11. No security-type roll up metal doors shall be permitted on Williams Street; and 12. All existing easements are retained. SECTION 3. BE IT FURTHER ORDAINED, That this Ordinance shall take effect two weeks from and after its passage, as provided by law.
